Data Protection Act registration

If you process personal information for the following purposes you must register under the Data Protection Act:
  • accountancy/auditing
  • administration of justice and legal services
  • canvassing political support amongst the electorate
  • constituency casework
  • credit referencing
  • crime prevention and prosecution of offenders (including use of CCTV for these purposes)
  • debt administration and factoring
  • education
  • health administration and provision of health services
  • mortgage/insurance broking/insurance administration
  • pastoral care
  • private investigation
  • provision of financial services and advice
  • research
  • trading and sharing in personal information
  • pensions administration
  • accounts and records.
If you process information only for the purposes of advertising, marketing and public relations business, staff administration, accounts and records for your own business you may not have to register provided you strictly comply with the Data Protection Act principles which require that all data is:
  • fairly and lawfully processed
  • processed for limited purposes
  • adequate, relevant and not excessive
  • accurate
  • not kept longer than necessary
  • processed in accordance with the data subjects' rights
  • secure
  • not transferred to countries outside the EEA without adequate protection
However, if you use third party databases for marketing purposes or use data obtained from a Credit Referencing Agency then you still must register. Based on your responses we will prepare the notification form setting up the purposes for which your business processes personal data. Please note that the notification form will be prepared only once. We will email this to you for signature and onward transmission to the Information Commissioner. 

Our service is priced at £79 plus VAT. The notification fee payable to the Information Commissioner is not included.*

*The flat rate fee of £35 per annum has been replaced with a two-tier structure. From 1 October 2009 the fee depends on the company’s size and turnover, with the exception of public authorities whose fees are based on the organisation’s size only. Companies (data controllers) with fewer than 250 employees and turnover of less than £25.9 million fall into Tier 1 and continue to pay the fee of £35 per annum. Companies with 250 or more staff and a turnover of £25.9 million or more are in Tier 2 and must pay a fee of £500 annually. In order to maintain the registration the fees must be paid to the Commissioner every year.
